Waiver of Liability: Portable Power Tools Agreement

This Agreement is made between Cumberland Kayak, MUBA Ventures, LLC referred to as ("Clients"), and the independent contractor listed below referred to as ("Contractor"). 

In consideration of Contractor’s use of the Client's chainsaw and/or other portable power tools, Clients and Contractor mutually agree as follows: 

1. Clients has the right to require Contractor to wear safety equipment, such as eye protection, chaps, gloves, ear protection, and a hard hat while using the chainsaw and/or other portable power tools.   

2. Clients is not responsible for any personal injury or property damage that may result from Contractor’s use of the chainsaw and/or other portable power tools. 

3. Contractor will be solely responsible for any personal injury or property damage that may arise from the use of the chainsaw and/or other portable power tools. 

4. Contractor will indemnify Clients from any claims, liabilities, losses, costs, or damages, including attorneys’ fees, arising from Contractor’s use of the chainsaw and/or other portable power tools. 

5. This Waiver shall be effective as of the date of signing.

THE UNDERSIGNED CONTRACTOR AGREES THAT THEY HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE TO EXEMPT AND RELIEVE CUMBERLAND KAYAK AND MUBA VENTURES, LLC, ITS OWNERS, OFFICERS, AGENTS AND SERVANTS, FROM LIABILITY FOR PERSONAL INJURY, ILLNESS, PROPERTY DAMAGE OR LOSS OF LIFE. CONTRACTOR AGREES TO FOLLOW ALL EVENT RULES AND CDC REGULATIONS.
